At Quick-Garden we are committed to respecting the privacy choices of our customers and the Website visitors. By accessing the Website or buying the Products or using our Services, you become subject to this Policy.

1.4.              We may change this Policy from time to time. We will post any Policy changes on Website additionally sending you an email informing about changes made. Continued use of the Website and/or our Services implies your acceptance of the revised Policy.

2.                   PERSONAL DATA WE COLLECT 

2.1.              Purchase and service information. When you use the Website, Purchase the Products or use our Services, Quick-Garden may collect certain contact information from you, such as your first and last name, organization name, city, state and zip code, email address, and phone number (collectively, "Purchase Information"). When purchasing the Products, you will be required to provide additional information that may include a credit card number or other banking or payment information ("Billing Information"). This information is required by Quick-Garden to verify your identity, to sell the Products, and set up your Services and Products. Contact information is used in purpose to prepare to enter into contract with customer and proper implementation of it.

2.2.              Purchase and communication information. In order to sell Products and to provide Services to you and to improve its Services Quick-Garden may collect information that is created or provided by you in connection with your purchase and use of the Services (collectively, "Purchase and communication information"), including order information, chat logs, email logs and information about your actions in various client areas on the Website. We use Purchase and communication information to market our Products and Services to you in a more personalized manner.

2.3.              Site Information. Quick-Garden may use cookies and other technical means to collect and analyze certain information about how you and other visitors use the Website. This technical information includes Internet Protocol (IP) addresses, browser information, and the preceding and succeeding websites you have visited, among other things. 2.5.              We assure you that we process your personal data only on legitimate basis, i.e. your personal data is collected and processed only:

(a)                 When you purchase Products – we process your personal data on purchase agreement basis;

(b)                 When you save Products basket, we process your personal data in order to take steps prior to entering into a contract;

(c)                 When you give your consent to process your personal data;

(d)                 When applicable laws oblige us to process your personal data.

2.6.              Our services are not designed for minors under the age of 18. We do not intentionally gather Personal Information about visitors who are under the age of 18.

3.                   RETENTION OF PERSONAL DATA

3.1.              Your personal data are processed as long as it is necessary to implement Products purchase agreement and to provide Services to you but not less than we are obliged to process your personal data by applicable law. Your personal data, processed by us on basis of your consent, is processed and stored until you withdraw such consent.

3.2.              We may retain your information after it is no longer necessary to provide Services under purchase or other agreement concluded between us and customer to comply with the law, prevent fraud, resolve disputes, troubleshoot problems and to comply with other legitimate obligations.

4.                   DISCLOSURE OF PERSONAL DATA

4.1.              Quick-Garden uses third party service providers to perform certain business-related services. When Quick-Garden employs such third party service providers to perform services on its behalf, Quick-Garden will only provide them with your Personal data that they need to perform their specific services. Each third party service providers is required by contract to keep such transferred Personal data confidential and not to use it for any purpose other than providing services to Quick-Garden.

4.2.              Quick-Garden may share your Personal Data with entities that are controlled by or under common control with Quick-Garden (each, an "Affiliate") for the purpose of assisting Quick-Garden in providing its Services to you. In that event, any such Affiliate will use Personal Data solely as permitted under this Policy.

4.3.              Quick-Garden may disclose Personal data if required to do so by law or to comply with a legal obligation, or if it believes in good faith that such action is necessary to: (a) protect the rights or property Quick-Garden or (b) protect the property or safety of (i) users of the Website, the Products or the Services or (ii) any third party. If Quick-Garden is required by law to disclose any of your Personal Data, we will use reasonable efforts to provide you with notice of that disclosure requirement, unless we are prohibited from doing so by statute, subpoena or court or administrative order. e. Quick-Garden reserves the right to sell its business or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets. You acknowledge that such transfers may occur, and that any acquirer or successor of Quick-Garden may continue to use your Personal Data as set forth in this Policy.

4.4.              Your personal data can be disclosed also to our trusted partners with which we have contracted, such as courier companies, construction companies, companies which process any payment you make to us and others.  

4.5.              If we decide to engage advertisers to promote our products and services, the advertisers and their advertising networks may require anonymised personal data to serve relevant adverts to you and others. We will never disclose identifiable information about individuals to advertisers, but we may provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help our advertising partners provide a tailored and targeted campaign, relevant for a sub-section of our users (for example, women in Lithuania). In some instances we may use personal data we have collected from you to enable our advertising partners to display their advertisement to their target audience.

5.                   UPDATES, QUESTIONS AND COMPLAINTS

5.1.              You have right to request Quick-Garden to provide you with a) your Personal data that is being kept at Quick-Garden, b) information about your Personal data retrieval sources; c) information about the purpose of keeping your Personal data; d) information about what recipients, if any, might have been given information about your Personal data within the past year. Also, you can submit any questions or complaints regarding your Personal data storage and usage by contacting us at [email protected]. You will be given with requested information after your identity is verified.

5.2.              You may update or delete Personal data in our database (including Contact and Billing Information that you have provided to us) by contacting us at [email protected]. If you delete information, we will only retain such copies of the information as are necessary for us to comply with governmental orders, resolve disputes, troubleshoot problems, or enforce any agreement you have entered into with us.

5.3.              You may submit a complaint about the way your Personal data is stored or processed by contacting us at [email protected]. However, if your Personal Data storage is terminated, further service provisioning might become difficult or even impossible.

5.4.              Upon your request you will receive information associated with your Personal data in written form within 30 calendar days.

5.5.              If after you have received your Personal data you noticed any discrepancies, you can submit a written request to us to revision your Personal data. After such request is submitted we will make necessary amendments to your Personal data and(or) we will stop any data processing operations associated with your Personal data, with an exception of Personal data storage, within 5 business days since your written notice.

5.6.              If after getting acquainted with your Personal data you ascertain that your Personal data is being processed illegally and(or) improperly, you have a right to make a written request for us to review your Personal data. After you submit such a request we will delete all of your Personal data hat is being processed illegally and(or) acquired improperly, or we will stop any data processing operations associated with such Personal data, with an exception of your Personal data storage, within 10 business days since your written notice.

5.7.              You have the right to request to erase your personal data. Your personal data will be erased upon receipt of your request. We may however retain certain aspects of your personal details for the purposes of maintaining records of applicable laws implementation . Your personal data will not be deleted from our database if, upon receiving your request, we will determine that:

(a)   your personal data is needed to achieve the purpose for which it was collected or processed;

(b)   consent you gave for processing of your personal data is not withdrawn;

(c)  you did not agree with your personal data processing, but such processing is necessary because of our legitimate interest;

(d)  processing of your personal data is subject to European Union and/or national legislation.

(e)  we need to process your personal data for establishment, exercise or defence of legal claims.

5.8.              You have the right to restrict processing of your Personal data. After such restriction we will no longer take any action other than personal data storage. You may restrict processing of your personal data in any of the following circumstances:

(a)  your personal data is inaccurate (personal data processing actions in this case will be restricted for a period enabling us to verify the accuracy of the personal data);

(b) your personal data is processed unlawful, but you do not agree to delete your data;

(c)  your personal data is necessary for the establishment, exercise or defence of legal claims.

(d)  you have objected to processing your personal data. Personal data processing actions in this case will be  restricted for a period enabling us to verify whether the legitimate grounds of us override those of you.

5.9.              You have right to data portability. Right to data portability means that you have right to receive information concerning your Personal data, which you have provided to us, in a structured, commonly used and machine-readable format. In case of technical capabilities, and upon your request, such data may be forwarded directly to another person specified by you.

5.10.           You can withdraw your consent at any time by contacting us using the contact details in paragraph 9 below.

5.11.           You have the right to lodge a complaint to the national Data Protection Agency (DPA) in the country of residence in the event where your rights may have been infringed. We would, however, appreciate the chance to deal with your concerns before you approach the DPA and find a solution at your satisfaction. So please contact us in the first instance.

6.1.              Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. We have no control over, do not review, and cannot be responsible for these outside websites or their content.
